Terms of Service

Webinly lets you upload a video, schedule a webinar, share a public registration page, and host the watch room with chat, attendance tracking, and timed offers. We send the registration and reminder emails on your behalf.

Webinly is an actively developed product. Features are added and changed regularly. We don't offer a service-level agreement (SLA) yet; we provide the service on a reasonable-best-effort basis.

You are responsible for the credentials you use to sign in (we use a third-party authentication provider to manage that: email/password or Google sign-in, same standards you'd expect anywhere else).

One account per person. You must be at least 16 years old (or the minimum age in your country, if higher).

You keep ownership of everything you upload: videos, descriptions, offer copy, brand images. By uploading, you give Webinly a non-exclusive license to host, transcode, and serve that content to the people you choose to share it with. That license ends when you delete the content or your account.

You confirm that you have the rights to upload what you upload (especially video content). If a third party tells us you don't (copyright, trademark, defamation), we will respond to the takedown notice and may remove the content.

You may not use the Service to:

• Send spam, phishing, or unsolicited bulk messages. We use shared sending infrastructure and abuse from one host hurts everyone.
• Email a list you bought, rented, scraped, swapped, or were given by someone else. You may only email people who gave you permission — by registering for your webinar, filling in your form, or buying from you. If you import contacts, you are confirming they opted in to hear from you.
• Host content that is illegal, harassing, defamatory, or violates someone else's privacy.
• Impersonate another person or organization.
• Reverse-engineer, scrape, or attempt to break the security of the Service.
• Build a competing product on top of Webinly.
• Resell access to Webinly without our written agreement.

We may suspend or terminate accounts that violate this section. For severe violations (e.g. illegal content, malware, spam at scale) we may act without prior notice.

When you create a webinar, Webinly sends emails to the people who register. Those emails come from a Webinly-controlled domain and identify your webinar, not your business directly.

Every email includes an unsubscribe link. Once a recipient unsubscribes we won't send them further reminders for any webinar they have not actively registered for. Confirmation emails for webinars they did register for are transactional and continue to be delivered.

Webinly is a paid product. Hosting webinars requires a paid plan (billed monthly or annually). You are charged when you pick a plan at checkout, and your plan renews automatically at the end of each billing period until you cancel. Current plans, prices, and what each plan includes are shown on the billing page inside your dashboard before you pay.

You can cancel at any time from the billing page. Cancelling stops future renewals; any wind-down or refund treatment that applies to the current period is described on the billing page at the time you cancel. If we change the price of your plan, we will notify you by email before the change applies to your next renewal.

Each plan includes a live-webinar room size (the number of attendees included in the live room at once) and usage allowances for recording and storage. Depending on your plan, a platform fee applies to sales you make through Webinly checkout; the percentage for each plan is shown on the plan page before you subscribe.

If more attendees join a live broadcast than your plan's included room size, each additional concurrent live attendee (a “flex seat”) is billed to the payment method on file at USD 0.50 per seat after the broadcast ends. You can turn this off by locking your live room to the included size in your account settings; when the room is locked, additional attendees are not admitted and no flex-seat charge is made. Flex-seat charges are usage-based and are separate from your recurring subscription.

Each plan also includes a number of unique evergreen (automated) webinar viewers per billing cycle. If more unique viewers watch your automated webinars than your plan includes, each additional unique viewer is billed to the payment method on file at USD 0.25 per viewer at the end of the billing cycle. Rewatches by the same viewer within a cycle are not counted again. You can turn this off by capping your evergreen viewers at your plan size in your account settings; when capped, new viewers beyond the included number are paused and no evergreen-viewer charge is made. Evergreen-viewer charges are usage-based and are separate from your recurring subscription.

Payments are processed by third-party payment processors. Your card details go to the processor directly and never touch our servers. Prices exclude any taxes that your country requires us or you to pay.

We aim for high uptime but do not guarantee a specific number. We may need to take the Service down for maintenance; we try to do that during low-traffic windows.

We may add, remove, or change features at any time. If a change materially reduces what your account can do, we will give you at least 30 days' notice.

You can delete your account from the dashboard at any time. Doing so removes your webinars, registrations, and content within 30 days (see the Privacy Policy).

We may terminate or suspend your account if you violate these terms, abuse the Service, or fail to pay. For non-emergency cases we will email you first and give a chance to address the issue.

The Service is provided “as is”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or perfectly secure.

To the maximum extent permitted by law, Webinly is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising from the Service is capped at the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD 100.

These limits do not apply where the law prohibits them (for example, our gross negligence or willful misconduct).

You agree to defend and indemnify Webinly against claims, damages, and costs arising from (a) the content you upload, (b) your use of the Service in violation of these terms, or (c) your infringement of someone else's rights.

These terms are governed by the laws of the Kingdom of Morocco. Any disputes will be brought before the competent courts of Casablanca, Morocco, except where applicable consumer law in your country gives you the right to use a local court.

We may update these terms when the product evolves. If a change is material we will email registered hosts at least 14 days before it takes effect. Continuing to use the Service after the change means you accept the new terms.
